These Terms of Service ("Terms") govern your use of the Cyticx website monitoring platform ("Service") operated by Cyticx ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using the Service in any capacity, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be legally bound by them. If you do not agree, you may not use the Service.
2. Description of Service
Cyticx provides website uptime monitoring, performance tracking, screenshot capture, and related analytics services. Features available to you depend on your subscription plan. We reserve the right to modify, suspend, or discontinue any feature at any time with reasonable notice.
3. Account Registration
You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Subscriptions and Billing
Paid subscriptions are billed in advance on a recurring monthly basis via Stripe. By providing payment information, you authorize us to charge the applicable fees. Subscriptions automatically renew unless canceled before the renewal date. Refunds are not provided for partial billing periods except where required by law.
- Free trials are provided as described at sign-up and do not require a credit card (unless specified).
- You may cancel your subscription at any time through the billing portal.
- Downgrading or canceling does not delete your data immediately; it remains accessible until the period ends.
5. Acceptable Use
You agree not to use the Service to:
- Monitor websites or systems you do not own or have explicit permission to monitor.
- Perform denial-of-service attacks or stress testing beyond normal uptime checks.
- Scrape, harvest, or collect data from third-party websites in violation of their terms.
- Circumvent rate limits, access restrictions, or attempt unauthorized access to our systems.
- Resell or redistribute the Service without written authorization.
6. Data and Privacy
We collect and process data as described in our Privacy Policy. You retain ownership of data you submit. We do not sell your data to third parties. Monitoring logs and screenshots may be stored for up to the period defined by your plan.
7. Uptime and Service Reliability
We strive to maintain high availability of the Service but do not guarantee 100% uptime. Scheduled maintenance will be communicated in advance where possible. We are not liable for losses arising from Service interruptions.
8. Limitation of Liability
To the maximum extent permitted by law, Cyticx shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising from your use of the Service. Our total liability shall not exceed the amounts paid by you in the twelve months preceding the claim.
9. Termination
We may suspend or terminate your account at our discretion if you violate these Terms or engage in abusive, fraudulent, or harmful behavior. You may terminate your account at any time by contacting us. Upon termination, your data may be deleted after a grace period.
10. Changes to Terms
We may update these Terms from time to time. We will notify you via email or an in-app notice at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance.
11. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Disputes shall be resolved in the courts of Miami-Dade County, Florida.
